These Terms of Service (“Terms”) apply to your access to and use of the websites and other online products and services (collectively, the “Services”) provided by Sentienta QualityAI Advanced Technology Research Private Limited (“Sentienta QualityAI,” “QualityAI,” “we,” or “us”). By clicking “I Accept” or by using our Services, you agree to these Terms, including the mandatory arbitration provision and class action waiver in Section 15. If you do not agree to these Terms, do not use our Services.

We may update these Terms from time to time. When we do, we will notify you via email, a notice on our Services, or by updating the date at the top of these Terms. Unless otherwise stated, changes will be effective immediately upon notice. Continued use of our Services after changes confirms your acceptance of the amended Terms. If you disagree, please discontinue using the Services.

2. Eligibility

You must be at least 13 years old to use our Services. If you are a parent or legal guardian of a user under 18 (or legal majority), you are responsible for their actions related to the Services. If you use the Services on behalf of another person or entity, you confirm you are authorized to accept these Terms on their behalf and agree they will be responsible for any violations.

We do not endorse or assume liability for any third-party content uploaded by users. However, we may remove content that violates these Terms or is objectionable in our sole discretion.

We reserve the right to terminate accounts or access without prior notice for violations of these Terms.

3. User Accounts and Security

You retain ownership of your User Content but grant Sentienta QualityAI and affiliates a worldwide, royalty-free license to use, reproduce, adapt, publish, and distribute your content as needed to provide the Services. This includes perpetual use of User Data for internal business and service improvement purposes.

You warrant that you have rights to any content you upload and that your content does not violate any laws or third-party rights. We may remove content at our discretion.

• Resell or copy our Services without permission
• Interfere with others’ use or the operation of our Services

Content you upload must comply with all laws and not infringe on intellectual property, privacy, or contain harmful material.

All rights in the Services, including content, design, and technology, belong to Sentienta QualityAI or its licensors. We grant you a limited, nonexclusive, revocable license to use the Services according to these Terms.

7. Trademarks

Our brand names, logos, and trademarks are owned by Sentienta QualityAI and cannot be used without written permission. Other trademarks on our site belong to their owners.

Any feedback you provide may be used by Sentienta QualityAI for any purpose without compensation or obligation to you.

We may feature or link to third-party content. Your interaction with such content is at your own risk. We do not endorse or guarantee third-party content.

You agree to indemnify and hold harmless Sentienta QualityAI and its affiliates, employees, and agents from any claims arising out of your use of the Services, your content, or violations of these Terms.

11. Disclaimers

Our Services are provided “as is” without warranties. We do not guarantee accuracy, reliability, or that the Services are free from viruses or other harmful components. You use the Services at your own risk.

12. Limitation of Liability

Sentienta QualityAI and affiliates will not be liable for indirect, incidental, punitive, or consequential damages. Our total liability is limited to the greater of ₹10,000 or the amount you paid for Services in the past 12 months, to the extent permitted by law.

13. Release

You release Sentienta QualityAI and its affiliates from claims related to disputes with other users or third parties.

14. Publicity

By using the Services, you consent to Sentienta QualityAI using your name and logo for marketing and promotional purposes.

15. Disputes and Arbitration

These Terms are governed by the laws of India. Except for small claims and injunctive relief matters, disputes will be resolved by binding arbitration in Bangalore under Indian arbitration laws. Arbitration will be on an individual basis; class actions are waived.

You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing contact@qualityai.in with your full name and intent to opt out.

16. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is invalid, the rest remain effective. Failure to enforce rights is not a waiver. You may not assign these Terms without written consent.
